RESOLUTION NO. 5908 Series of 2016
A RESOLUTION EARNESTLY REQUESTING THE HUMAN RIGHTS VICTIMS’ CLAIMS BOARD THROUGH THE COMMISSION ON HUMAN RIGHTS REGION 12 TO EXPEDITE THE DISTRIBUTION OF REPARATIONS TO VICTIMS OF MARTIAL LAW ABUSES

WHEREAS, Republic Act 10368 otherwise known as the Human Rights Victims’ Reparation and Recognition Act signed into law on February 25, 2013 by His Excellency President Benigno Simeon Aquino III that acknowledges the heroism and sacrifices of those who suffered abuses during the dictatorial regime of President Ferdinand Marcos;
WHEREAS, RA 10368 acknowledges that it is the state’s obligation to recognize the human rights victims and provide them reparations;
WHEREAS, there are 75,730 claimants who applied for reparations as of the deadline for submission set by law on May 2015;
WHEREAS, out of the 75,730, more or less 6,000 are from Cotabato City and Maguindanao;
WHEREAS, while the victims are supposed to get their claims on or before May 12, 2016, only about 20% of the total number of claimants have been deliberated and decided on by the Human Rights Victims’ Claims Board;
WHEREAS, the victims may have to wait beyond May 2016 considering that the Human Rights Victims’ Claims Board requested more time to decide on all 75,730 applications because of lack of time, inadequate number of personnel and resources;
WHEREAS, while we understand the predicament of the Board, we also strongly sympathize with the victims who have suffered long enough and now deserve to get what is due them;
WHEREAS, the government should act swiftly through the Human Rights Victims’ Claims Board because most of the victims are now old and sick while some have already died waiting for their monetary and non-monetary reparations;
WHEREFORE, on motion of Honorable Mohammad Ali C. Matabalao unanimously seconded, it was –
RESOLVED, as it is hereby resolved to earnestly request the Human Rights Victims’ Claims Board through the Commission on Human Rights Region 12 to expedite the distribution of reparations to victims of martial law abuses.
RESOLVED FURTHER to send a copy of this Resolution to the Office of the President, the Senate and the House of Representatives.
